November 19, 2014 – Court grants Alphatec’s motion for summary judgment that plaintiff is not entitled to provisional rights for infringement and that certain claims of asserted patents are invalidity as indefinite.

June 12, 2014 – Court denies Alphatec’s motion for summary judgment of invalidity for for failure to meet the written description requirement and enablement requirements of 35 U.S.C. Sec. 112(a).

April 7, 2014 – Court issues claim construction order and sets the hearing regarding Alphatec’s motion for summary judgment for May 1, 2014.  Alphatec had previously filed a motion for summary judgment of invalidity for failure to meet the written description requirement and enablement requirements of 35 U.S.C. Sec. 112(a).
