Complaint for trademark infringement, unfair competition, false advertising and fraud. The defendants placed a paid advertisement that appears whenever a consumer searches for the plaintiff’s Solar X Sunglasses on the Google search engine. The defendants’ advertisement, which is also known as a “sponsored link”, offers “Solar X Sunglasses – Only $24 per dozen/$2 per piece.” In fact, the defendants do not offer the plaintiff’s Solar X Sunglasses in their inventory of merchandise.
